Terms of Service

These Terms are a legally binding agreement between you and VESCEND TECHNOLOGY LIMITED. By accessing, registering for, publishing on, purchasing from, or using Vibe Shot Club, you agree to these Terms and our Privacy Policy. If you disagree, do not use the Services.

• You must have legal capacity to enter this agreement and meet the minimum age required where you live. Paid content may be purchased only by adults or persons with valid authorization.
• If you use the Services for an organization, you represent that you can bind that organization.
• You are responsible for ensuring that your location, content, and intended use comply with applicable law and third-party rules.

VSC is a community and learning platform for AI visual creators. It offers portfolios, forums, creator spaces, articles, collections, courses, creative tools, membership, and community benefits. Features and availability may vary by region, device, account status, or version.

• We may reasonably add, modify, limit, replace, suspend, or discontinue features for product, security, legal, operational, or commercial reasons.
• Maintenance or incident response may occur without advance notice. Unless agreed in writing, these Terms do not promise a particular service level or permanent availability of any feature.

You must provide accurate information, protect your credentials, and remain responsible for activity through your account.

• Accounts may not be sold, rented, transferred, maliciously shared, or created in bulk through false or automated means.
• You may not use multiple accounts to obtain duplicate trials, points, levels, or promotional benefits.
• Tell us promptly about unauthorized access. We may request verification or limit access where information is inaccurate or risk is detected.

VSC supports original work, constructive discussion, and respect for creators. You are responsible for content and conduct associated with your account.

• Do not publish unlawful, infringing, fraudulent, harassing, hateful, impersonating, privacy-invasive, or illegal sexual content involving minors.
• Do not evade payment, access, membership, points, rate, moderation, security, or geographic restrictions.
• Without written permission, do not scrape, mirror, reverse engineer, bulk copy, resell, or use the Services or non-public data to train a competing product.
• Do not use bots, malicious code, bulk accounts, denial-of-service methods, metric manipulation, or unauthorized access to interfere with the Services or others.

You retain rights you lawfully hold in works, images, text, prompts, courses, comments, and other material (“User Content”) and are responsible for obtaining all rights, permissions, and consents needed to publish and process it.

• You grant VSC a worldwide, royalty-free, non-exclusive, limited license to host, copy, format, and process User Content only as reasonably needed to operate, display, distribute, protect, and promote content you make public and to provide requested features.
• The license normally ends after deletion, except for backups, legal retention, completed sharing, and dispute or security handling.
• We may restrict, remove, or disable access to content reasonably believed to violate these Terms, create risk, or require action by law.

Eligible creators may publish free or paid articles, collections, and courses. Creators must accurately describe content, disclose pricing, hold necessary rights, and comply with review and community rules.

• A paid purchase grants you a personal, non-exclusive, non-transferable, non-resalable access license. It does not transfer ownership.
• You may not screen-record, bulk-download, resell, publicly distribute, share accounts, or otherwise bypass paid access. Lawful fair quotation is unaffected.
• Creator opinions and educational material do not represent VSC. You must decide whether content suits your creative, commercial, or professional needs.
• VSC may remove content for review, rights claims, legal requirements, or safety and will address eligible affected orders under the refund rules in these Terms.

Paid articles, collections, and courses are digital content. Price, currency, scope, and total amount are displayed before purchase. Current purchases are one-time payments and do not auto-renew.

• Stripe processes payments. VSC does not store complete card numbers or security codes. You authorize Stripe to charge the amount shown using your selected payment method.
• After Stripe confirms payment, VSC normally unlocks access for the purchasing account immediately. There are no physical goods, shipping, physical returns, or exchanges.
• Taxes, exchange rates, and bank fees are handled as shown during checkout and under applicable law and payment-provider rules.
• A success page alone is not final fulfillment evidence; Stripe confirmation and VSC order records control.

You may cancel before payment by leaving Stripe Checkout, with no charge. Once digital content is paid for and access is delivered, refunds are unavailable for change of mind, non-use, or personal device issues except where required by law or expressly allowed in this section.

• Cases eligible for review include a verifiable duplicate charge; access still missing 24 hours after Stripe confirms payment and unable to be fixed; content removed, materially unavailable, or materially different from its purchase-page description at purchase; unauthorized transactions; and cases required by law.
• Normally non-refundable cases include change of mind, non-use or partial use, personal device or network problems, subjective dissatisfaction with a creator's style or learning outcome, and access restrictions caused by a Terms violation.
• Email support@vescend.com promptly with the account email, content title, order or payment date, amount, currency, and reason. Never send complete card details or security codes.
• We normally provide an initial response within 5 business days. Approved refunds are returned through Stripe to the original payment method. VSC normally initiates them within 5 business days after approval, and banks commonly require a further 5–10 business days to post the funds.
• A refund, chargeback, or payment reversal may result in removal of corresponding access. Mandatory consumer rights remain unaffected.

AI features are probabilistic. Output may be inaccurate, incomplete, objectionable, similar to output for others, unavailable for legal protection, or unsuitable for your intended use. Review it before publishing, relying on it, or using it commercially.

• VSC does not guarantee originality, non-infringement, accuracy, safety, or suitability for legal, medical, financial, or other high-risk use.
• You must ensure inputs, references, prompts, and outputs comply with applicable law and third-party service terms.

Other than User Content, the Services, software, interfaces, design, text, documentation, trademarks, databases, and other VSC material belong to us or our licensors and are protected by intellectual-property law.

No right to use VSC names, marks, source code, datasets, or proprietary material is granted except as expressly stated in these Terms.

VSC may rely on Stripe, authentication, cloud infrastructure, AI models, storage, linked sites, and other third-party services. They operate independently under their own terms and privacy practices. We cannot control availability, decisions, prices, or data practices beyond our reasonable control.

We may investigate, restrict, suspend, or terminate access and remove content where we reasonably believe there is a breach, nonpayment, fraud, abuse, infringement, security risk, legal requirement, or harm to VSC or others. We may act without notice where notice is impractical, unsafe, or unlawful.

Termination for misconduct normally creates no refund right. You may stop using the Services and request account deletion, subject to records required for law, accounting, security, disputes, and enforcement.

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation, no data loss, or that content and AI output meet a particular purpose. Keep independent copies of important material.

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive, or consequential loss or loss of profit, revenue, opportunity, goodwill, data, or use. Our aggregate liability relating to the Services will not exceed what you paid for the relevant Services during the 12 months before the event. Liability that cannot legally be limited remains unaffected.

These Terms are governed by the laws of Hong Kong SAR, without regard to conflict-of-law rules. Before formal proceedings, please contact us and attempt in good faith to resolve the issue. Hong Kong courts have exclusive jurisdiction without limiting mandatory consumer rights where you live.

We may update these Terms to reflect changes in the Services, law, risk, or business practices. Material changes will receive reasonable notice and apply on the stated date. Continued use after that date constitutes acceptance where permitted by law.
